TERMS OF USE

1. About these Terms

These Terms of Use ("Terms") govern your use of Clubwise Golf at clubwisegolf.com and its related tools (the "Service"). The Service is operated by Kristoffer Land, doing business as Clubwise Golf ("Clubwise Golf", "we", "us"). By using the Service you agree to these Terms. If you do not agree, please do not use it.

2. What the Service does

Listing Check gives decision-support estimates for used golf equipment listings: a fair local-sale range, an offer target, and a Buy / Negotiate / Pass call. Estimates come from a rules-based calculation that uses retailer asking-price data where available and built-in estimates where it is not. Founding Beta is $5 lifetime access. Lock in the founding price once and keep it: saved history now, unlimited supported Listing Checks after the beta. If retailer price context launches, it is included for Founding Beta members at no extra cost. Retailer price context is planned, not available yet, and not guaranteed. Your purchase does not depend on it.

3. Estimates are not advice

  • Estimates are for information only. They are not an appraisal, price guarantee, authentication, condition inspection, fitting, or financial advice.
  • Retailer figures are asking prices taken from product data on the capture date shown. They are not sale prices, and prices and availability may have changed since.
  • Fair local-sale ranges are calculated from retailer asking prices using fixed percentages where retailer data is available, and from built-in estimates for specific models and categories where it is not. They are an assumption, not a record of what clubs sold for.
  • You are responsible for your buying and selling decisions. Verify the club, its condition, its authenticity and the price yourself.

4. Beta

The Service is in beta. Features, limits, data coverage and pricing may change. Free checks may be limited. We may change or remove features, and results can contain errors or gaps.

5. Accounts

A free account is not required to try some features. Saved history and other paid features need an account. You must be at least 18, provide an accurate email address, and keep your sign-in secure. You are responsible for activity under your account. Purchase access is matched to the email on your account, so use the same email at checkout.

6. Founding Beta purchase

  • What you get. A one-time payment of $5.00 USD gives the account whose email you used at checkout lifetime access, including saved history now and unlimited supported Listing Checks after the beta. If retailer price context launches, it is included for Founding Beta members at no extra cost. Retailer price context is planned, not available yet, and not guaranteed. Your purchase does not depend on it.
  • Not transferable. Access belongs to one account and may not be shared or resold.
  • Changes. We may improve or change the Service. We will not ask you to pay again to keep the core features included when you bought.
  • Payment processing. Payments are handled by the MadeThis checkout provider. We do not receive your card details; the checkout provider handles them and keeps its own payment records.
  • Refunds. See our Refund Policy.

If you accidentally buy Founding Beta more than once, contact Clubwise Golf at team@clubwise.madethis.app or through the in-app "Report a bug or share feedback" link, and we will refund the extra purchase.

7. Acceptable use

You agree not to:

  • scrape, crawl or copy the Service or its data, or use bots or automated bulk queries;
  • resell, republish, redistribute or build a competing dataset or service from our outputs or data;
  • bypass or interfere with free-check limits, security or access controls;
  • reverse engineer the Service, or attempt to access other users' data;
  • use the Service for anything unlawful or in a way that harms others or the Service.

8. Third-party data and links

  • Retailer data comes from third parties. We are not affiliated with, endorsed by, or sponsored by any retailer or manufacturer. Brand and product names belong to their owners and are used only to identify products.
  • Some links to retailers may be affiliate links, and we may earn a commission if you buy. See our affiliate disclosure where links appear. Third-party sites have their own terms and policies.

9. Your content and feedback

You own the information you enter and the checks you save. You give us a limited license to process them to provide and improve the Service. If you send feedback, we may use it without obligation to you.

10. Intellectual property

The Service, its design, methods and text belong to us or our licensors. We give you a limited, revocable, non-transferable license to use the Service for your own buying and selling decisions, as allowed by these Terms.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for losses from buying or selling decisions you make using the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places do not allow certain limits, so parts of this section may not apply to you.

13. Suspension and ending

We may suspend or end access if you break these Terms. You may stop using the Service at any time. If we ever discontinue the Service, we will give reasonable notice where we can.

14. Changes to these Terms

We may update these Terms. The "Last updated" date shows the current version. If you keep using the Service after a change, you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of North Carolina, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in or serving Orange County, North Carolina. Please contact us first so we can try to resolve any issue informally.
